1. Purpose of Van Livre
Van Livre provides software features that support management and tracking of passenger transportation by vans, including organizations, drivers, passengers, itineraries, stops, trips, and operational history.
The app is a software tool. The actual transportation service, vehicle operation, driver licensing, vehicle compliance, and compliance with traffic and transportation rules remain the responsibility of the person or organization providing or managing transportation.
2. Account and authentication
Some features may require an account and authentication. Users must provide accurate information, keep credentials secure, and report unauthorized use when they become aware of it.
Authentication is configurable and may include social login. When an external authentication provider is used, that provider’s terms and rules may also apply.
3. Roles, organizations, and submitted data
Users and organizations must enter only information they are authorized or otherwise entitled to use for transportation operations. This includes passenger data, addresses, photographs, itineraries, stops, and operational information.
Each organization is responsible for correctly managing user access and removing permissions that are no longer necessary.
4. Location use
During an active trip, Van Livre may use foreground and background location, as permitted, to track the vehicle, calculate progress, detect approaching and arriving at stops, and keep the trip running while the app is in the background or the screen is locked.
Background location is not used for advertising. Users can change the permission in device settings, understanding that some features may stop working correctly.
5. Safe driving
Drivers must comply with traffic laws and must not interact with the app in an unsafe manner while the vehicle is moving. Any action that requires attention to the screen must be performed at a safe time and place or by another authorized person.
Route, progress, and stop information are operational aids and do not replace driver judgment, road signs, or instructions from authorities.
6. Offline operation and synchronization
Van Livre may store data locally to support partial offline operation and later synchronize changes with the API.
Synchronization conflicts, network outages, GPS limitations, battery-saving settings, and operating-system restrictions may affect real-time updates. Users should account for these limitations in their operation.
7. Acceptable use
Van Livre may not be used for unlawful purposes or to compromise the service, other users, or third parties. In particular, users must not:
- access accounts, organizations, or data without authorization;
- submit false information with intent to defraud or harm others;
- attempt to bypass security controls, permissions, or technical limits;
- use the service for covert surveillance, stalking, location-based advertising, or another purpose incompatible with the stated transportation operation;
- interfere abusively with the API, infrastructure, or service availability.
8. Availability and changes
The service may be subject to maintenance, temporary unavailability, technical changes, or feature changes. Van Livre aims to operate properly, but connectivity, GPS, operating systems, and external infrastructure can cause interruptions beyond its direct control.
Features may be changed when needed for security, compatibility, product development, or compliance with legal and platform requirements.
9. Intellectual property
Van Livre software, brand, visual identity, and proprietary content are protected by applicable law. Access to the app grants only a limited, revocable, non-exclusive, non-transferable license to use the service in accordance with these Terms.
10. Liability
Nothing in these Terms excludes rights that cannot be waived under Brazilian law, including consumer-protection rules when applicable.
Van Livre does not replace the legal duties of the transportation provider, driver, or organization and does not guarantee that GPS, connectivity, maps, operating systems, or external services will be entirely error-free. Any liability will be assessed under applicable law and the specific circumstances.
11. Suspension, termination, and deletion
Accounts may be restricted or suspended when there are signs of fraud, security risk, violation of these Terms, or a legal requirement, subject to applicable rights.
Users can request deletion of the account and associated data through Van Livre’s public deletion page. Deletion does not prevent limited retention when a legal obligation or another legitimate ground requires it.
12. Governing law and contact
These Terms are governed by the laws of the Federative Republic of Brazil. Questions about the service, privacy, or these Terms can be sent to suporte@vanlivre.com.br.
Where consumer-protection law requires a different venue or procedure, the applicable mandatory rule prevails.
